(1) There is hereby created within the office of
the executive director of the department of transportation an office of transportation safety, the
head of which shall be the director of the office of transportation safety. The director shall be
appointed by the executive director of the department of transportation in accordance with the
provisions of section 13 of article XII of the state constitution. The director of the office of
transportation safety shall appoint the necessary staff of his office in accordance with the
provisions of section 13 of article XII of the state constitution.
(2) The office of transportation safety and the director thereof shall exercise their powers
and perform their duties and functions, specified by this article, under the department of
transportation and the executive director thereof, as if the same were transferred to the
department by a type 2 transfer, as such transfer is defined in the "Administrative Organization
Act of 1968", article 1 of this title.
