Violation - penalty

(1) A manufacturer who violates any of the provisions
of this part 33 or any rule promulgated pursuant to section 24-32-3305 is subject to revocation or
suspension of the manufacturer's registration, fines, or any other measures as prescribed by rule
promulgated by the division or other applicable state law. The division may issue a fine of up to
one thousand dollars for each violation. Multiple violations of this part 33 committed during the
construction of a single factory-built structure constitute one violation. A separate violation is
deemed to have occurred with respect to each factory-built structure involved. A civil penalty
collected pursuant to this section must be transmitted to the state treasurer who must credit the
same to the building regulation fund created in section 24-32-3309.
(2) In the case of any unit certified under the federal act, civil and criminal penalties
provided for in the federal act must be imposed. Any civil penalty collected pursuant to this
section must be transmitted to the state treasurer, who must credit the same to the building
regulation fund.
