Department of military and veterans affairs - creation

(1) There is hereby
created a department of military and veterans affairs, the head of which shall be the adjutant
general who shall be appointed by the governor pursuant to law.
(2) The office of the adjutant general, created in part 1 of article 3 of title 28, is a type 2
entity, as defined in section 24-1-105, and exercises its powers and performs its duties and
functions under the department of military and veterans affairs.
(3) The department of military and veterans affairs consists of the following divisions:
(a) The Colorado National Guard, created in part 2 of article 3 of title 28. The Colorado
National Guard is a type 2 entity, as defined in section 24-1-105, and exercises its powers and
performs its duties and functions under the department of military and veterans affairs.
(b) The Colorado division of civil air patrol, created in article 1 of title 28. The Colorado
division of civil air patrol is a type 1 entity, as defined in section 24-1-105, and exercises its
powers and performs its duties and functions under the department of military and veterans
affairs.
(c) Repealed.
(d) The Colorado state defense force, when organized by the governor pursuant to article
4 of title 28. If organized, the Colorado state defense force is a type 2 entity, as defined in
section 24-1-105, and exercises its powers and performs its duties and functions under the
department of military and veterans affairs.
(e) Repealed.
(f) The division of veterans affairs, created in part 7 of article 5 of title 28. The division
of veterans affairs is a type 2 entity, as defined in section 24-1-105, and exercises its powers and
performs its duties and functions under the department of military and veterans affairs.
(g) The Colorado board of veterans affairs, created in section 28-5-702. The Colorado
board of veterans affairs is a type 2 entity, as defined in section 24-1-105, and exercises its
powers and performs its duties and functions under the department of military and veterans
affairs.
