Department of health care policy and financing - creation - repeal

(1) 
There is hereby created a department of health care policy and financing, the head of which shall
be the executive director of the department of health care policy and financing, which office is
hereby created. The governor shall appoint the executive director, with the consent of the senate,
and the executive director shall serve at the pleasure of the governor. The reappointment of an
executive director after initial election of a governor shall be subject to the provisions of section
24-20-109.
(2) The powers, duties, and functions of the department of health care policy and
financing include the powers, duties, and functions relating to the "Colorado Medical Assistance
Act", as specified in articles 4, 5, and 6 of title 25.5.
(3) Repealed.
(4) (a) The powers, duties, and functions of the department of health care policy and
financing include the powers, duties, and functions relating to the "Colorado Indigent Care
Program", as specified in part 1 of article 3 of title 25.5.
(b) This subsection (4) is repealed, effective July 1, 2025.
(4.5) The powers, duties, and functions of the department of health care policy and
financing include the powers, duties, and functions relating to the old age pension health and
medical care program, as specified in section 25.5-2-101.
(5) The medical services board, created in part 3 of article 1 of title 25.5, is a type 1
entity, as defined in section 24-1-105, and exercises its powers and performs its duties and
functions under the department of health care policy and financing.

(7) Repealed.
(8) The powers, duties, and functions of the department of health care policy and
financing include the powers, duties, and functions relating to programs, services, and supports
for persons with intellectual and developmental disabilities, as specified in article 10 of title
25.5. Such powers, duties, and functions are allocated to the division of intellectual and
developmental disabilities, created in section 25.5-10-203 (2), which division is part of the office
of community living, created in section 25.5-10-101. The office of community living and the
division of intellectual and developmental disabilities are type 2 entities, as defined in section
24-1-105.
(9) The Colorado healthcare affordability and sustainability enterprise created in section
25.5-4-402.4 (3) is a type 2 entity, as defined in section 24-1-105, and exercises its powers and
performs its duties and functions under the department of health care policy and financing.
