(1) After the county clerk and recorder in each
county in which the special school district organization election is held has surveyed the returns
of such election, a certificate of return shall be retained on file in each office of the county clerk
and recorder.
(2) If the majority vote in each affected school district is in favor of the final approved
plan of organization and any increase in the mill levy to be imposed on territory affected by the
plan of organization is approved by the eligible electors residing within the affected territory, the
plan of organization shall be deemed adopted. If the plan of organization is adopted and it results
in creation of a new school district, the county clerk and recorder in each county in which the
special school district organization election was held shall furnish to the commissioner a map
and legal description of the new school district with the name and number by which the same
shall be designated. If the plan of organization is adopted and it results in the detachment and
annexation of territory between existing school districts, the county clerk and recorder in each
county in which the special school district organization election was held shall furnish to the
commissioner a map and legal description of the affected school districts following detachment
and annexation of the territory.
