(1) The department is authorized to seek, accept, and expend
public and private gifts, grants, and donations for the implementation of this article; except that
the department shall not accept a gift, grant, or donation if it is subject to conditions that are
inconsistent with this article or any other law of the state.
(2) The general assembly hereby declares that, for purposes of section 17 of article IX of
the state constitution, implementation of an aligned education accountability system for public
education pursuant to this section is an important element in implementing accountable
education reform and accountable programs to meet state academic standards and may therefore
receive funding from the state education fund created in section 17 (4) of article IX of the state
constitution.
(3) The general assembly anticipates that the department may receive significant
amounts of federal moneys that may appropriately be used to implement this article and strongly
encourages the department to apply said federal moneys to the greatest extent possible in
implementing this article.
