Dispensing violent films to minors - misdemeanors

(1) No person shall
sell, rent, or otherwise furnish to a minor any video tape, video disc, film representation, or other
form of motion picture if:
(a) The average person, applying contemporary community standards, would find that
the work, taken as a whole, predominantly appeals to the interest in violence; and
(b) The work depicts or describes, in a patently offensive way, repeated acts of actual,
not simulated, violence resulting in serious bodily injury or death; and
(c) The work, taken as a whole, lacks serious literary, artistic, political, or scientific
value.
(2) For the purposes of this section, "minor" means any person under eighteen years of
age, and "serious bodily injury" shall be defined as provided in section 18-1-901 (3)(p).
(3) Any person who violates subsection (1) of this section is guilty of a civil infraction
and, upon conviction thereof, shall be punished by a fine of one thousand dollars; except that, for
a second or subsequent offense, the fine shall be five thousand dollars.
