Judgments and settlements - reporting

Any final judgment, settlement,
or arbitration award against an optometrist for malpractice shall be reported within fourteen days
by the optometrist's malpractice insurance carrier in accordance with section 10-1-125 or by the
optometrist if no commercial malpractice insurance coverage is involved to the board for review,
investigation, and, where appropriate, disciplinary or other action. Any optometrist who
knowingly fails to report as required by this section shall be subject to a civil penalty of not more
than two thousand five hundred dollars. The penalty shall be determined and collected in an
action brought by the board in the district court in the city and county of Denver, which court
shall have exclusive jurisdiction in such matters. All penalties collected pursuant to this section
shall be transmitted to the state treasurer, who shall credit the same to the general fund.
