(1) If the director determines that an applicant or
licensee has committed any of the acts specified in section 12-230-401, the director may:
(a) Issue a letter of admonition under the circumstances specified in and in accordance
with section 12-20-404 (4);
(b) Place a licensee on probation pursuant to section 12-20-404 (1)(b);
(c) Impose an administrative fine not to exceed two thousand five hundred dollars for
each separate offense; or
(d) Take disciplinary action as authorized in section 12-20-404 (1)(d).
(2) The director may send a licensee a confidential letter of concern under the
circumstances specified in section 12-20-404 (5).
(3) The director shall not enforce any provisions of this article 230 or rules promulgated
pursuant to this article 230 that are held unconstitutional, invalid, or inconsistent with federal
laws or regulations, including regulations promulgated by the United States food and drug
administration.
