Inactive license or certification - rights and responsibilities
Open in Lexace · Ask the AI about this section
(1) Persons
licensed or certified to practice any profession or occupation under this title 12 for which
postgraduate study or attendance at educational institutions is required in order to obtain renewal
of the license or certification may have their names transferred to an inactive licensees or
certificate holders category under this section. Every regulator authorized under this title 12 to
issue licenses or certifications shall maintain a list of inactive licensees or certificate holders, as
applicable, and upon written notice to the regulator, the licensee or certificate holder shall not be
required to comply with any postgraduate educational requirements so long as the licensee or
certificate holder remains inactive in the profession or occupation. Each inactive licensee or
certificate holder shall continue to meet the normal registration requirements imposed upon the
licensee's or certificate holder's profession or occupation.
(2) The inactive status shall be noted on the face of any license or certification issued
while the licensee or certificate holder remains inactive. If the person seeks to resume the
practice of the person's profession or occupation after being placed on an inactive list, the person
shall file a proper application to reactivate the license or certification, pay the applicable renewal
fee, and meet any postgraduate study or in-service requirements that the regulator may determine
to be applicable in order to resume the practice.
(3) Engaging in the practice of a profession or occupation while on inactive status
pursuant to this section may be grounds for revocation.
