Emergency shutdown

When facts are presented tending to show that an
unreasonable hazard exists in the continued operation of a passenger tramway, after the
verification of the facts as is practical under the circumstances and consistent with the public
safety, the board, any member thereof, or the supervisory tramway engineer may, by an
emergency order, require the area operator of the tramway forthwith to cease using the same for
the transportation of passengers. The emergency order shall be in writing and signed by a
member of the board or the supervisory tramway engineer, and notice thereof may be served by
the supervisory tramway engineer, any member of the board, or as provided by the Colorado
rules of civil procedure or the "State Administrative Procedure Act", article 4 of title 24. The
service shall be made upon the area operator or the area operator's agent immediately in control
of the tramway. The emergency shutdown shall be effective for a period not to exceed seventy-
two hours from the time of service. The board shall conduct an investigation into the facts of the
case and shall take such action under this article 150 as may be appropriate.
