California Water Code § 1375

As prerequisite to the issuance of a permit to appropriate water the following facts must exist: (a) There must be an applicant. (b) The application must contain the matter and information prescribed by this division and be in the form required by the board. (c) The intended use must be beneficial. (d) There must be unappropriated water available to supply the applicant. (e) All fees due must be paid.
