As used in the chapter, âprivate utility damagesâ means the amount to which any private utility might be entitled by virtue of Chapter 8.5 (commencing with Section 1501) of Part 1 of Division 1 of the Public Utilities Code on account of the construction of the proposed improvement. In the resolution of intention, the legislative body, in its discretion, may order that private utility damages be included in the assessment.
