(a) For purposes of this section, the following terms have the following meanings: (1) “Community health care worker” means an individual who provides health care or health care-related services to clients in home settings. (2) “Employer” means a person or entity that employs a community health care worker. “Employer” does not include an individual who is a recipient of home-based services and who is responsible for hiring his or her own community health care worker. (3) “Violence” means a physical assault or a threat of a physical assault. (b) Every employer shall keep a record of any violence committed against a community health care worker and shall file a copy of that record with the department in the form and detail and within the time limits prescribed by the department.
