(a) On or before September 1, 2028, and every five years thereafter, the California State Auditor shall report the results of an audit of a sample of no less than three community college districts. The audit shall evaluate all of the following: (1) Whether each community college district’s policies and practices are adequate to detect, address, and prevent the reoccurrence of sexual harassment. (2) Whether each community college district’s policies and practices are consistent with federal and state law and best practices. (3) Whether the investigatory process for sexual harassment complaints can be improved. (4) For sexual harassment complaints that are substantiated following an investigation, analyze selected complaints within two years of the audit’s initial date to assess whether the discipline administered was proportional to the conduct, effectively deterred future harassment, and was consistent. (b) Notwithstanding Section 10231.5 of the Government Code, the California State Auditor shall report the findings of each audit conducted pursuant to subdivision (a) to the respective chairs of the Assembly Committee on Higher Education, the Senate Committee on Education, and the Joint Legislative Audit Committee, consistent with the requirements of Section 9795 of the Government Code. (c) This section shall remain in effect only until January 1, 2044, and as of that date is repealed.
