(a) The Secretary of the Department of Finance and Administration is authorized to adopt appropriate rules not inconsistent with this subchapter as he or she may deem necessary to carry out the intent and purposes of and to assure compliance with this subchapter. (b) The Arkansas Pollution Control and Ecology Commission is authorized to adopt appropriate rules not inconsistent with this subchapter to carry out the intent and purposes of and to assure compliance with this subchapter. (c) The Division of Environmental Quality shall have the authority to enter upon the property of any owner or operator of an aboveground storage tank to obtain information, conduct surveys, or review records for the purpose of determining substantial compliance, as defined by this subchapter and rules promulgated thereunder, with all state laws and rules and federal laws and regulations relating to aboveground storage tanks prior to the secretary's approval of a claim for reimbursement or disbursement.
