(a) In its decree of condemnation, the court shall direct that if the sum adjudged shall not be paid within ten (10) days, the property shall be sold by a special commissioner, appointed for that purpose, upon twenty (20) days' notice. (b) However, only so much of the property shall be sold as will pay the assessment, costs, and penalty, and no more. Acts 1949, No. 260, § 25; A.S.A. 1947, § 80-3627.
