(a) The provisions of this chapter do not apply to emergency purchases. (b) Emergency purchases shall only be used for the preservation of life, health, or public property, and shall not be used to substantially improve the condition of an asset before the emergency. (c) Each public educational entity shall maintain records and copies of all documentation relating to and supporting a determination that transactions qualify as emergency purchases. (d) Any person using emergency purchases to avoid the intent of this chapter shall be guilty of violating the provisions of this chapter. Acts 2001, No. 1599, § 9.
