(a) As used in this subchapter: (1) "Lottery" means the same as defined in § 23-115-103 of the Arkansas Scholarship Lottery Act, § 23-115-101 et seq.; and (2) "Ticket or share" means the same as defined in § 23-115-103 of the Arkansas Scholarship Lottery Act, § 23-115-101 et seq. (b) A person commits the offense of lottery fraud if he or she: (1) Falsely makes, alters, forges, utters, passes, or counterfeits a ticket or share in a lottery with a purpose to defraud the Office of the Arkansas Lottery; or (2) Purposely influences the winning of a lottery prize through the use of coercion, fraud, deception, or tampering with lottery equipment or materials. (c) A violation of this section is a Class D felony. (d) In addition to the fine for a conviction under § 5-4-201 , a person convicted of a violation of this section is subject to an additional fine of not more than fifty thousand dollars ($50,000).
