Seizure of conveyances

(a) A conveyance subject to forfeiture under this subchapter may be seized by any law enforcement agent upon process issued by any circuit court having jurisdiction over the conveyance upon a petition filed by the prosecuting attorney of the judicial district. (b) Seizure without process may be made if: (1) The seizure is incident to an arrest or a search under a search warrant; or (2) Any law enforcement officer has probable cause to believe that the conveyance was used in the commission or attempt of: (A) A burglary; (B) A robbery; (C) A theft; (D) An arson; or (E) Trafficking of persons, § 5-18-103 .
