(a) When there is a guardian of the estate, all actions between the ward or the guardian and third persons in which it is sought to charge or to benefit the estate of the ward shall be prosecuted by or against the guardian of the estate as guardian, and the guardian shall represent the interests of the ward in the action. (b) In every case, process shall be served upon the guardian of the estate and in addition upon such other persons as by law required. Acts 1985, No. 940, § 28; A.S.A. 1947, § 57-847.
