Appeal not to delay vesting of title

(a) No appeal in any cause under this subchapter, nor any bond or undertaking given therein, shall operate to prevent or delay the vesting of title to real property or any interest therein or any easement in the State of Arkansas. (b) The State of Arkansas shall not be divested of any title to real property or any interest therein or any easement acquired under this subchapter by court except where the court finds that the property or any interest therein or any easement was not taken for public use. In the event of this finding, the court shall enter judgment as may be necessary: (1) To compensate the persons entitled thereto for the period during which the property was in the possession of the state; and (2) To recover for the state any deposit or funds paid to any person.
