Towing vehicles licensed in other states

(a) (1) A vehicle licensed in another state for use as a wrecker or similar towing vehicle may be used to tow an automobile or truck in this state only if: (A) The wrecker or similar towing vehicle licensed in another state is requested by the owner or operator of the vehicle to be towed; (B) The vehicle is not being towed as a result of a collision that occurred within this state; and (C) The vehicle is being towed: (i) In either direction across the border between Arkansas and a neighboring state; or (ii) Through Arkansas in transit to another state. (2) Subdivision (a)(1) of this section shall not apply to a vehicle used as a wrecker or similar towing vehicle if the vehicle: (A) Is licensed in an incorporated city or town in a state adjoining an Arkansas city or incorporated town that is divided by a state line; and (B) The city or town in the adjoining state is of greater population than the Arkansas city or town. (b) (1) The owner or operator of any wrecker or similar towing vehicle licensed in another state that is used to tow any automobile or truck in this state in violation of this section shall be guilty of a misdemeanor and, upon conviction, shall be fined at least one hundred dollars ($100) but not more than one thousand dollars ($1,000). (2) Each violation shall constitute a separate offense. (c) The Arkansas Towing and Recovery Board may promulgate rules for the enforcement of this section, including the imposition of civil penalties as set forth in § 27-50-1204 .
