(a) (1) In addition to the specific authority granted to the Arkansas Department of Transportation by this chapter to define terms and impose additional requirements, by rule, the department shall have the authority to promulgate additional rules, in the manner provided by law, in furtherance of this chapter. (2) These rules may include, but are not limited to, the establishment of reasonable safeguards in the transportation of hazardous materials, including, as the department finds appropriate, the use of escort vehicles and the temporary prohibition of transportation of hazardous materials during unsafe conditions, the establishment of a system requiring notification of public authorities prior to transportation of hazardous materials, the adoption by reference of laws or regulations of the United States, and the maintenance of records. (b) The department is empowered to enforce this chapter by any and all civil or criminal remedies provided by law. (c) All portions of this chapter, except this section, shall be fully operable and effective without the enactment of rules by the department. (d) Nothing contained within this chapter or requirements imposed by it shall be construed so as to relieve any person from the necessity of complying with any applicable laws or regulations of the United States.
