Creation - Director - Organization - Personnel

(a) There is created a Division of Arkansas Heritage. (b) (1) The executive head of the division shall be the Director of the Division of Arkansas Heritage. (2) The director shall be appointed by the Governor, subject to confirmation by the Senate, and shall serve at the pleasure of the Governor. (3) The director shall report to the Secretary of the Department of Parks, Heritage, and Tourism. (c) The director, with the advice and consent of the Governor and the secretary, shall appoint the heads of each of the programs and agencies of the division. All other personnel of the division shall be employed by and serve at the pleasure of the director. However, nothing in this section shall be so construed as to reduce any right which an employee of the division shall have under any civil service or merit system. (d) Each agency or program of the division shall be under the direction, control, and supervision of the division. The director may delegate his or her functions, powers, and duties to the head of any agency or program of the division as he or she shall deem desirable and necessary for the effective and efficient operation of the division.
