(a) The Securities Commissioner shall administer this chapter. (b) The commissioner may: (1) Make, amend, and rescind any rules, forms, and orders that the commissioner deems necessary or appropriate to carry out this chapter, including without limitation rules and forms governing applications and reports; and (2) Define any terms, whether or not used in this chapter, if consistent with this chapter. (c) A rule, form, or order shall not be made, amended, or rescinded unless the commissioner finds that the action is: (1) Necessary or appropriate in the public interest or for the protection of consumers; and (2) Consistent with the purposes fairly intended by the policy and provisions of this chapter.
