Clearing right-of-way following derailment or wreck

(a) Any railroad operating in this state shall be required to clear its right-of-way of debris and wrecked equipment within ninety (90) days following any derailment or train wreck. (b) In the event any railroad fails to comply with this requirement the Arkansas Department of Transportation, upon petition of any ten (10) citizens, shall conduct a hearing for the purpose of determining the cause of the railroad's failure to comply with this requirement. (c) The department is authorized to file suit in a court of competent jurisdiction for an order requiring the railroad's compliance with this section.
