(a) Before issuing a request for proposals or an invitation for bids, a public entity shall: (1) Seek the advice and consent of the Building Authority Division and the Arkansas Development Finance Authority; and (2) Be designated as the responsible public entity for purposes of developing the qualifying project. (b) A responsible public entity shall: (1) Adopt and make publicly available guidelines that are consistent with the rules promulgated under this chapter before issuing a request for proposals or an invitation for bids for a qualifying project under this chapter; and (2) Identify a representative of the responsible public entity who is available to meet with private entities that are considering submitting a proposal.
