(a) The Director of Arkansas Tobacco Control may promulgate rules under the Arkansas Administrative Procedure Act, § 25-15-201 et seq., necessary to effectuate the purposes of this subchapter. (b) (1) The Secretary of the Department of Finance and Administration, the director, and their employees, in the regular course of conducting inspections of wholesalers and retailers, as authorized under the Arkansas Tobacco Products Tax Act of 1977, § 26-57-201 et seq., may inspect cigarettes to determine if the cigarettes are marked as required by § 20-27-2106 . (2) If the secretary discovers cigarettes that are not marked as required, the secretary shall notify the director. Amended by Act 2019, No. 910,§ 3486, eff. 7/1/2019. Acts 2009, No. 697, § 2.
