(a) Except as provided in subsection (b) of this section, any person who violates any provision of this subchapter or who violates any rule or order issued under this subchapter shall be guilty of a Class A misdemeanor. (b) (1) It shall be unlawful for a person to: (A) Violate any provision of this subchapter or any rule or order issued under this subchapter and leave the state or remove his or her person from the jurisdiction of this state; (B) Purposely, knowingly, or recklessly conduct blasting in a manner prohibited by this subchapter or any rule or order issued under this subchapter and thereby create a substantial likelihood of adversely affecting the health, safety, welfare, or property of any person, including the state or any political subdivision of the state; or (C) Purposely or knowingly make any false statement, representation, omission, or certification in any document required to be maintained under this subchapter or to falsify, tamper with, or render inaccurate any monitoring device, method, or record required to be maintained under this subchapter. (2) A person who violates this subsection shall be guilty of a Class D felony.
