(a) As an accreditation body, the Department of Health may charge and collect the following fees: (1) First mammography tube, seven hundred dollars ($700) to be collected at the beginning of each three-year accreditation period; (2) Each additional mammography tube, five hundred dollars ($500) to be collected at the beginning of each three-year accreditation period; and (3) Each additional review of clinical images and phantoms, one hundred dollars ($100) to be collected at the time of submission of clinical images and phantoms for review, except that the maximum annual cost for additional review of clinical images and phantoms shall not exceed three hundred dollars ($300). (b) (1) The department may prorate the accreditation fee for a mammography tube that is accredited for less than the three-year accreditation period. (2) The department may bill on an annual basis for one-third (1/3) of the accreditation fee. (c) (1) All revenue derived from fees collected pursuant to this section shall be deposited into the State Treasury and credited to the Public Health Fund. (2) Subject to such rules as may be implemented by the Chief Fiscal Officer of the State, the disbursing officer for the department may transfer all unexpended funds that pertain to fees collected, as certified by the Chief Fiscal Officer of the State, to be carried forward and made available for expenditures for the same purpose in any following fiscal year.
