The penalty for violation of this subchapter shall be as follows: (1) The first violation shall be a Class B misdemeanor; (2) The second violation shall be a Class A misdemeanor; and (3) The third or subsequent violation shall be a Class D felony. Acts 1999, No. 1350, § 4.
