Issuance of bench warrant discretionary

(a) The court may, at its discretion, order a bench warrant to be issued on any indictment. (b) However, where the punishment is limited to a fine of one hundred dollars ($100) or less, a bench warrant shall not be issued unless the court is satisfied that there is reason to believe the defendant will escape punishment if a bench warrant is not issued. Crim. Code, § 150; C. & M. Dig., § 3049; Pope's Dig., § 3875; A.S.A. 1947, § 43-1112.
