(a) Any person who knowingly violates any provisions of this subchapter or any rules promulgated thereunder shall be guilty of a misdemeanor and upon conviction shall be subject to a fine of not more than one thousand dollars ($1,000) or imprisonment for not more than six (6) months, or both. In the event of a violation by a corporation or other entity organized for a common business purpose, this penalty shall extend to any officer, director, or employee who knowingly participated in the violation. (b) Any prime supplier or broker who refuses to provide products pursuant to an assignment under this subchapter shall be liable for a penalty of not more than ten thousand dollars ($10,000) which may be recovered in a civil action, and the prime supplier or broker may be enjoined from continuing such violation.
