(a) Any person, firm, or corporation violating § 15-72-206 , § 15-72-208(a) , § 15-72-217 , § 15-72-208(b) , § 15-72-210 , or § 15-72-211 is subject to a civil penalty for each violation not to exceed two thousand five hundred dollars ($2,500), to be assessed by the Oil and Gas Commission. (b) If the civil penalty is not recovered by the commission within the time frame specified by the commission, the civil penalty and a reasonable attorney's fee to be fixed by the court may be recovered in an action brought by the commission in the name of the State of Arkansas. (c) The civil penalty and attorney's fees collected shall be turned into the general road fund of the county where a leak is located to be used on the roads, bridges, and highways of the county, in the discretion of the county court.
