(a) Every five (5) years all notifications of intent to quarry and of temporarily closed quarry must be refiled with the Division of Environmental Quality by certified mail on or before the operator's anniversary date, with any modifications made necessary by changed conditions in the quarry site, such as changes in the affected acreage, majority ownership of the operator, changes in public roads and man-made structures adjacent to the quarry site, or new technology. (b) For failure to refile a notification of intent or notification of temporarily closed quarry, divisional enforcement procedures, citations, and fines will be the same as for § 15-57-405 .
