(a) (1) Except as provided in subdivision (a)(2) of this section, the Arkansas State Game and Fish Commission is authorized to agree to hold and save the United States free from damages due to the design, construction, operation, maintenance, repair, replacement, or rehabilitation of: (A) Projects for water resource development, wildlife conservation, or other purposes; and (B) Any state-sponsored or locally sponsored project-related betterments. (2) Subdivision (a)(1) of this section shall not apply to damages due to the fault or negligence of the United States or its contractors. (b) Subsection (a) of this section does not: (1) Obligate the General Assembly to provide future appropriations; or (2) Abrogate the provisions of Arkansas Constitution, Article 5, § 29.
