Regulatory considerations

In developing rules to implement this subchapter, the Arkansas Natural Resources Commission shall consider: (1) The current and projected level of nutrients in the soil within the area; (2) The current or potential impacts of surplus nutrients within the area; (3) Litter produced and applied in the area; (4) Commercial fertilizer, compost, and other sources of nutrients applied within the area; (5) The current or projected nutrient needs within the area, including the nutrient level necessary to maintain soil fertility, current and future cropping patterns, and those crops' demands for nutrients; (6) The soil type, geology, hydrology, and other physical characteristics of the area; (7) The types of water bodies and the uses of the waters within the area; and (8) Any other relevant information necessary to effect the purposes of this subchapter.
