Condemnation proceedings and judgment

(a) The circuit court shall impanel a jury of twelve (12) persons, as in other civil cases, to ascertain the amount of compensation that the research park authority shall pay for the real property, an interest in the real property, or an easement that the authority is taking. (b) The matter shall proceed and be determined as in other civil cases. (c) In all cases of infants or incompetent persons, when no legal representative or guardian appears in the infant's or incompetent person's behalf at the hearing, the court shall appoint a guardian ad litem who shall represent interests of the infant or incompetent person for all purposes. (d) Compensation shall be ascertained and awarded in the proceeding and established by judgment in the proceeding. Acts 2007, No. 1045, § 1.
