(a) Each county, municipality, public instrumentality, and other governmental entity of this state is authorized and empowered, upon ordinance or resolution of the governing body, to enter into long-term or short-term contracts with a county jail board, municipal jail board, or public instrumentality jail board under which the board provides nightly or other periodic housing of the entity's misdemeanants or other incarcerants for fee compensation or other consideration. (b) (1) Each county, municipality, and public instrumentality is authorized and empowered to adopt ordinances or resolutions that provide for the creation of boards under this subchapter. (2) The boards shall constitute and comprise political subdivisions of the county or municipality that creates the boards or, in the case of public instrumentality boards, political subdivisions of the county or municipality that created the public instrumentality that creates the boards.
