40-814. Duty of railroads to transport; liability for failure; exceptions A. Railroad corporations shall: 1. Start and run cars for the transportation of persons and property at regular and fixed times. 2. Furnish sufficient accommodations for all persons and property which, within a reasonable time previous to the time of departure, are offered for transportation at the place provided for taking and leaving persons and property. 3. Transport between such places persons and property upon the payment of lawful charges therefor. B. If a railroad corporation refuses or fails to transport persons or property as required by this section, or to leave the persons or property at the places of destination, it shall be liable to the party aggrieved for damages thereby sustained. C. Railroad corporations may decline to receive any person who is intoxicated, afflicted with contagious disease, or otherwise unfit to be admitted into its cars.
