40-433. Agent or employee of telegraph or telephone company failing or refusing to send or deliver message; classification An agent, operator or employee of a telegraph or telephone office who knowingly fails or refuses to send a lawful and prepaid message received at the office for transmission, or knowingly postpones its order of transmission, or knowingly fails or refuses to deliver the message received, is guilty of a class 2 misdemeanor.
