36-1104. Enforcement; registration of brands and labels A. The department of health services shall enforce the provisions of this article. The department may approve and register such brands and labels intended for use under the provisions of this article as are submitted which in its judgment conform to the requirements of this article. B. In any prosecution under this article, the fact that a brand or label involved in the prosecution has not been submitted to the department for approval, or if submitted, has not been approved by it, is immaterial.
