26-1070. Appellate counsel; civilian counsel A. The trial counsel and defense counsel of courts-martial shall serve in the capacity of appellate counsel on an appeal authorized by this chapter. B. The accused may be represented by civilian counsel at his own expense. If the defense or trial counsel is unable to perform his duties because of illness or other disability, the convening authority shall appoint a qualified trial or defense counsel to continue the proceedings.
