(a) A commissioned officer of the militia who uses contemptuous words against the President or Vice President of the United States, the United States Congress, the United States Secretary of Defense, the United States Secretary of Homeland Security, the secretary of a military department of the United States, or the governor or legislature of this state may be punished by separation with characterization up to dishonorable discharge and by such other punishment as a court-martial may direct. (b) A court-martial may not impose a sentence of confinement under this section.
