Statement of Candidacy

(a) Any person desiring to become a candidate at any election for the office of council member may become a candidate by filing in the office of the judge of probate of the county in which the city is situated, a statement in writing of the candidacy, accompanied by an affidavit taken and certified by the judge of probate or by a notary public that the person is duly qualified to hold the office for which he or she desires to be a candidate. The statement shall be filed at least 30 days before the day set for the election and shall be in substantially the following form: “State of Alabama “County of Russell “I, the undersigned, being first duly sworn, depose and say that I am a resident of the City of Phenix City, that I desire to become a candidate for the office of council member, Post__, in the city at the election for the office to be held on the ___ day of September next and I am duly qualified to hold the office if elected thereto and I hereby request that my name be printed upon the official ballot at the election. “Signature of candidate________________________ “Typed name of candidate______________________ “Subscribed and sworn to before me by said ___ on this __day of ___, 2___. “Filed in my office on this ___ day of ___ , 2___. ____________________ “Judge of Probate” (b) The statement shall be accompanied by a petition signed by not less than, nor more than 10 electors, who shall be designated as the candidate’s sponsors. In the case of a candidate for a district post, sponsors may but need not reside within the district in which the candidate resides. No elector shall sign more than one petition, and should an elector do so, he or she shall be guilty of a misdemeanor. With each signature shall be stated the place of address of each sponsor. Nominating petitions shall be in substantially the following form: “We, the undersigned 10 electors of the City of Phenix City, hereby nominate and sponsor _____ , whose residence is ____ , as a candidate for the office of council member, Post ___ , in the election to be held on the ___day of September, 2___; and we individually certify that our names have appeared on the rolls of registered voters of this city within the last year, that we are qualified to vote for a candidate for the council, and that we have not signed any other nominating petition for that office. We further state that we know ___ to possess the qualifications necessary for the office, and to be in our judgment a fit and proper person to hold the office. Witness our hands on this the ___ day of ___, 2___.”
