(a) The Randolph County Commission, by ordinance of the county commission, may regulate the distance from a church or school that a licensee of the Alcoholic Beverage Control Board may be located in the unincorporated area of the county. Any ordinance enacted pursuant to this section shall not apply to any licensee of the Alcoholic Beverage Control Board operating pursuant to a license granted before January 30, 2014, or to a licensee operating lawfully pursuant to the ordinance before any change in the location or the establishment of a school or church affecting the operation of a licensee pursuant to the ordinance. Any distance pursuant to the ordinance shall be specified from the property line of the licensee to the property line of the church or school. (b) Any ordinance adopted pursuant to this section may be enforced by a civil penalty levied by the Randolph County Commission not to exceed five hundred dollars ($500) per day for each day of violation after notice and a hearing before the county commission. In addition, the ordinance of the county commission may be enforced by injunctive relief in the Circuit Court of Randolph County.
