Disposition of Funds

All sums collected and deposited in the fund established by Section 45-52-234.23 shall be expended for the implementation of this subpart, including, but not limited to, paying salaries and other expenses involved in making investigations and studies necessary to determine whether or not particular defendants will be granted the benefits of this subpart, administration required to carry out this subpart, transportation of defendants to and from their places of employment, matching any federal and state grants which may be available in relation to the purposes of this subpart and implementation and administration of such treatment, rehabilitation, educational, intervention, and pretrial diversion programs, as the commission created pursuant to Section 45-52-234.29 determines to be required by law or consistent with the purposes of this subpart. If, at the end of any calendar year, there remains a surplus in the fund established by Section 45-52-234.23, the surplus shall be paid over to the General Fund of Morgan County, if a majority of the members of the commission created pursuant to Section 45-52-234.29, by affirmative vote, decide at a duly convened meeting of the commission that such surplus, or any portion thereof, is in excess of an amount necessary to carry out this subpart.
