(a) A member who terminates his or her employment as a uniformed officer, other than by reason of death or disability, after he or she has 15 years of service, the last 10 years of service being without a break in service exceeding one year, but before he or she is eligible to receive a benefit under Section 45-49A-63.60, shall receive a benefit equal to the benefit he or she would otherwise receive under Section 45-49A-63.60. The benefit shall be payable in accordance with Subpart 5 beginning on the first day following the later of his or her termination of employment as a uniformed officer or his or her 65th birthday. (b) If a member who does not have at least 15 years of service, the last 10 years of service being without a break in service exceeding one year, terminates his or her employment as a uniformed officer before becoming eligible for a retirement benefit under Section 45-49A-63.60 for any reason other than death or disability, he or she shall receive a single sum equal to his or her contributions to the plan under Section 45-49A-63.102 as soon as practicable following his or her termination of employment.
