Exception When Identity of Owner Cannot Be Reliably Established

If the evidence produced by an electronic device does not produce an image or video of the license plate with sufficient clarity for a law enforcement officer to determine the identity of the owner, and if the identity cannot otherwise be reliably established, then no notice of violation may be issued pursuant to this part.
